The Court of Appeal has reaffirmed the strict time limits for enforcing judgments in Nigeria in the case of CBN v. Balogun Samuel & 2 Ors which centred on a 29-year-old legal dispute


The CBN successfully argued that the enforcement action was statute-barred. Under Section 11(2) of the Limitation Act, 2006 (FCT), any action to enforce a judgment must be brought within twelve years of the judgment becoming enforceable. Since the judgment was enforceable immediately upon delivery in 2010, the window for enforcement closed in 2022.


The Court of Appeal reaffirmed that actions to enforce judgments must be brought within twelve years.
