Court of Appeal clarifies authentication requirements for court records


In Appeal No. CA/L/CV/960/2021 – Falma Organics Limited & Another v. IPCA Laboratories Limited, the Court of Appeal, constituted by Joseph Eyo Ekanem, A.M. Lamido, and O.O. Oyewumi, pronounced on the validity of court records relied upon in appellate proceedings. The court held, among other things, that a record of proceedings signed solely by a Court Registrar is invalid and cannot be relied upon as proof of the contents of proceedings. According to the court, only the presiding judge has the authority to validly sign and authenticate the record of the court’s proceedings.
